3/4/22 Waupaca County Sheriff Issues Response To Accusations Of Brady Violations

Waupaca County Sheriff Timothy Wilz issued a response Thursday to the District Attorney’s accusation that his department violates Brady standards by altering reports. District Attorney Veronica Isherwood sent a letter to 79 district attorneys after a hearing in which Wilz admitted that officers’ reports were regularly corrected. Isherwood contends that could change the context of a report thereby omitting potential evidence that a defense attorney could use on their client’s behalf. Wilz says the report in a criminal trespass case from September of 2020 was reviewed for accuracy before it was submitted to the District Attorney’s Office. He says it was corrected to accurately reflect the intent and actions of the reporting officer. The officer was made aware of the correction to the report and was in agreement with it. But during a hearing the Officer said he wasn’t .The report was submitted to an outside agency and Wilz says the agency found no willful deceit or any other improper purpose in changing the report. He added there were no Brady/Giglio issues. Wilz says he is asking the Wisconsin Department of Justice to complete a full review of the operations of the Sheriff’s Department, along with the District Attorney’s Office.
