Federal Lawsuit Filed For FDL Police Custody Death

Officials in Fond du Lac are being sued by the family of a man who died while in police custody. The federal lawsuit was filed Monday by the estate of Christopher L. Cary. It names the city, police and paramedics in it. Cary died shortly after a traffic stop on December 23rd. Sheboygan Police were asked to investigate the incident. On February 8th Fond du Lac County District Attorney Eric Toney issued his and the Sheboygan Police Department’s findings. Toney said during the traffic stop Carey swallowed cocaine in an effort to avoid being caught with it. He started to go into medical distress when he was placed in the back of a squad car. He died later at St Agnes Hospital. Police found $626 in his car and torn plastic sandwich bags with white residue that tested positive for crack cocaine. Officers at the scene rendered aid and called for an ambulance. Toney said there’s nothing medically different they could have done. Cary was stopped for not having his license plate properly displayed. The lawsuit contends Cary’s rights were violated due to an unreasonable search and seizure. The suit also contends police officers and paramedics didn’t do enough to try and save Cary’s life.
