FDL County DA Comments On Marco Sentencing

Fond du Lac County District Attorney Eric Toney recommended that a former Ripon High School teacher get two years in prison for having sex with a student. Instead Samantha Marco, formerly Samantha Fitzpatrick, got three years of probation and no jail time when she was sentenced last week. Toney says he understands why the judge went with probation, but feels some prison time was appropriate. “I understand why the court composed that particular sentence given some of the things the defendant shared in court but I wasn’t sympathetic to that and I hoped the court would impose some prison, but I respect the judge’s sentence.” Toney says when kids go to school parents should have an expectation that they are going to be safe and that type of behavior is not going to occur. Marco resigned from the Ripon Area School District in May of 2017. A presentence investigation by the state’s Department of Corrections also recommended a two-year prison sentence for Marco.
