Avery Request For Substitute Judge Premature

A Sheboygan County Circuit Court judge has ruled against Steven Avery’s request for a substitute judge. Judge Angela Sutkiewicz ruled Monday the request was “premature.” She feels the US Court of Appeals still has jurisdiction over his appeal and her court “has limited jurisdiction to consider new evidence.” The new evidence is contained on a CD, which Avery’s defense says contains previously undisclosed evidence in the case. The appellate court sent the evidence down to the circuit court last month to consider first. Avery’s attorneys have until Sunday to submit their brief. The court will issue a ruling on it within the next two months.
